MI AG appealing ruling that dismissed case against former MSP sergeant

Grand Rapids, MICH -- Michigan Attorney General Dana Nessel is asking a federal appeals court to overturn a ruling by a lower court that dismissed the case against a former Michigan State Police sergeant.

Former sergeant Brian Keely was charged with second-degree murder and involuntary manslaughter for the death of Samuel Sterling. Keely hit Sterling with his police cruise while the suspect was attempting to run from officers to evade arrest.

The judge ruled last month that Keely was protected under the Supremacy Clause of the Constitution as he was acting as a federal officer at the time of the incident.

Nessel argues Keely was a state employee, not a federal employee and says the dismissal was a miscarriage of justice.
