GRAND RAPIDS (WOOD-AM) - Brian Keely, the former Michigan State Police sergeant who fatally struck a man last year, has asked a judge to dismiss the civil case against him.
The suit was filed on behalf of the family of Samuel Sterling.
Sterling, 25, ran away from a task force seeking to arrest him. He was hit in a Burger King parking lot in Kentwood.
A federal judge dismissed the criminal case against Keely in May. The defense said Keely was acting as a federal agent at the time of the incident.
Attorney General Dana Nessel called the decision a "miscarriage of justice" and filed an appeal last month.
